MORTGAGE BROKERAGE AGREEMENT AND DISCLOSURE
You have requested us to assist you in obtaining a first mortgage loan from a qualified lender and we hereby agree to assist you as your mortgage broker in obtaining such a loan, pursuant to the terms and conditions of this agreement.
PARTIES TO AGREEMENT:
In this agreement the parties shall be referred as follows:
THE FUNDING DEPOT INC., a New York State Registered Mortgage Broker having an office and place of business located at 11 Harrison Avenue, Brooklyn NY shall be referred as “we”, and (Your Name) Residing at (Your Address) shall be referred to as “you”.
LOAN APPLIED FOR:
Loan Amount: $ TBD Term: TBD Points: TBD
Your signed acceptance of a commitment for any other loan with the lender shall be deemed to be your agreement to a modification of the above loan request.
Our service to you as the mortgage broker shall include:
1. Counseling and assisting you in completion of all required application and forms.
2. Submitting and processing your application in accordance with the Lender’s procedures and guidelines.
3. Following up with you for any further information which may be required by the Lender.
4. Maintaining communications with the Lender.
5. Obtaining whatever expedited services may be available to us in our capacity as the mortgagor’s broker.
6. And reviewing and explaining to you the terms of the Lender’s commitment to make the loan.
The undersigned, under the penalties of perjury, does hereby certify that all statements and material submitted to
The Funding Depot Inc. are true and correct and do not represent any misstatement of fact.
It is important that you understand that as a Registered Mortgage Broker, we are not an agent or employee of the lender and that we cannot make mortgage loans or commitments, nor can we guarantee acceptance of your application into any particular loan program by the lender. The decision to accept or reject your application will rest solely with the lender. Similarly, the terms and conditions of any loan commitment shall be in the sole discretion of the lender.
BROKER FEE AND OTHER CONSIDERATION:
In consideration of the above services which we will perform as your Mortgage Broker, you hereby agree to pay us a fee equal to TBD of the loan amount at the time you sign and accept the loan commitment from the lender.
The interest rate, points, fees and other terms quoted in the lender’s commitment will encompass any consideration, including premium pricing, which we have received from the Lender. The specific amount of such consideration which we will receive from the Lender will not exceed 4% of the loan amount. We may be eligible to receive a lender paid bonus. You will be notified if this occurs.
I understand that certain mortgage products impose a prepayment penalty on the borrower. You will disclose the amount of or the formula for calculating the prepayment penalty and the terms of the prepayment penalty if any as soon as you know them.
SUCH POINTS AND FEES ARE COSTS OF OBTAINING THE LOAN AND ARE IN ADDITION TO THE AMOUNT YOU WILL ACTUALLY RECEIVE FROM THE LOAN.
The charges due at the time your application is submitted are estimated as follows:

THE BROKER APPLICATION FEE IS NON-REFUNDABLE. THE CREDIT REPORT AND APPRAISAL FEE BECOME NON-REFUNDABLE ONCE THE APPLICABLE SERVICE HAS BEEN COMMENCED. (THESE FEES ARE ESTIMATES ONLY.) IF WE HAVE COLLECTED FEES IN EXCESS OF OUR ACTUAL COSTS, WE WILL REFUND THE DIFFERENCE TO YOU AT OR PRIOR TO CLOSING.
